If you are a party to a divorce and your circumstances have changed, you have the right to ask the court to amend your divorce decree and issue a new child custody or visitation order. If you are the custodial parent and your ex-spouse has either failed to pay child support or has paid less than the court-ordered amount, you can ask the court to use other means, including garnishment, to enforce the support order.

In Florida, a motion for contempt for failure to pay support can come from different sources. If support payments are made directly from one parent to the other, the custodial parent can file a private action to enforce a child support order. If, however, payments are made through the court, the Florida Department of Revenue can file the motion for contempt. If you have moved to Florida after a divorce and have a child support order from another state, you can register that order in Florida and have it enforced in the state courts.

The failure to pay support in Florida can have serious consequences. If the motion for contempt is granted, the Department of Revenue can suspend your driver's license, levy your bank accounts, seize your tax returns or report you to a credit bureau.
